Consent & Media Release

Consent & Media Release

Effective Date: July 22, 2026 Provided by: HueVine Skincare LLC (marketing/media) with HueVine PLLC (clinical images).

This document explains how HueVine handles photographs, video, and other media of you — including clinical "before and after" images — and how you give, limit, or withdraw consent. Your consent is voluntary and tiered: you may agree to some uses and not others, and you may change your mind.

Important: This media consent is separate from, and not a condition of, receiving any treatment or purchasing any product. Declining media consent will never affect the care you receive or the price you pay.

1. What This Covers

Photographs, video, audio, and digital images of you, your treatment areas, and your results, whether captured in our location or submitted by you.

2. Tiered Consent — You Choose

You may separately consent to each use below. Each is opt-in; leaving one unchecked means "no" for that use.

  • Clinical/medical record only — images kept in your confidential file to document care. (Used even without marketing consent, as part of treatment records.)
  • Internal training & education — de-identified where possible, used to train our clinical team.
  • Website & marketing — use on huevine.com and printed materials.
  • Social media — use on HueVine's social channels, where images may be re-shared by others.
  • Before-and-after galleries — paired images showing results.

You may consent with your face shown or request face cropped/obscured; indicate your preference when you sign.

3. Biometric Notice & Consent (Facial Images)

Some images — particularly facial photos and any facial-mapping or imaging tools we may use — can involve biometric identifiers or biometric information. Several states regulate this, most strictly the Illinois Biometric Information Privacy Act (BIPA), 740 ILCS 14/, which requires informed written consent before collecting facial-geometry data and allows individuals to sue even without proving harm (Rosenbach v. Six Flags Entertainment Corp., 2019 IL 123186; see also Norberg v. Shutterfly, Inc., 152 F. Supp. 3d 1103 (N.D. Ill. 2015)).

If you consent below, HueVine will collect and store facial-geometry data derived from your images solely to document your clinical care and to produce before-and-after comparisons you approve. We will retain this biometric data for no longer than three (3) years after your last treatment, or until you withdraw consent, whichever occurs first, after which it will be permanently destroyed. We will not sell, lease, trade, or otherwise profit from it, and will not disclose it except as permitted by law or with your consent. Our full written retention-and-destruction policy is publicly available at huevine.com/biometric-policy.

4. No Compensation; Ownership

Unless we agree otherwise in writing, you understand that approved media may be used without payment to you. HueVine holds and may use non-clinical promotional images it creates; clinical images that are part of your medical record are held and used only as your HIPAA authorization and applicable medical-privacy law permit (Section 8). You waive any right to inspect or approve the final use, except as stated in your selected tiers, and you release HueVine from common-law claims arising from uses you expressly authorized. Nothing in this release waives any right that cannot be waived in advance under law, including rights under biometric-privacy or consumer-protection statutes. This release does not cover uses you did not authorize.

5. Right of Publicity

We will not use your name, likeness, or images to imply an endorsement beyond the uses you approved. Your right of publicity under applicable state law is respected.

6. Withdrawing Consent

You may withdraw media/marketing consent at any time by contacting us. On withdrawal, we will stop new uses and make reasonable efforts to remove your images from materials we control (website, our social posts, galleries). We may be unable to recall images already printed, already re-shared by third parties, or embedded in prior campaigns, and clinical-record images are retained as part of your medical record as required by law. Withdrawal is not retroactive to uses already made in good faith.

7. Minors

We do not use images of anyone under 18 for marketing without the written consent of a parent or legal guardian, given separately. For anyone under 18, we obtain written parent/guardian consent before capturing any facial or biometric image, not only before marketing use.

8. HIPAA / Confidentiality Overlay

Before HueVine PLLC discloses any image that is part of your clinical record to HueVine Skincare LLC for marketing, you must sign a separate HIPAA-compliant authorization (45 C.F.R. § 164.508). That authorization will: identify the specific images and marketing uses; name HueVine Skincare LLC as the recipient; state that it expires on a stated date or event; state that you may revoke it in writing at any time by contacting hello@huevine.com, effective for future uses; state that your treatment, payment, and care are in no way conditioned on signing; and warn that information disclosed for marketing may be re-disclosed and no longer protected by HIPAA. Clinical confidentiality otherwise applies.

9. Changes & Contact

We may update this document; the effective date above reflects the latest version, and changes are not retroactive to consents already given. Questions or withdrawal: HueVine — hello@huevine.com — (248) 234-5001 — 17641 W 12 Mile Rd, Lathrup Village, MI 48076.
